Applying for a Marriage License

Both people who plan to marry must go to the Recorder's office together. Minnesota law does not require a waiting period, so the license is active the moment it is issued. You have six months to use it. After that, it expires and you have to apply again.

You need a valid photo ID. A driver's license or passport works fine. Each applicant must give their Social Security number at the time of application, but it will not appear on the license or certificate. If either person was previously married, bring the paperwork that ended that marriage. A certified copy of a divorce decree or a death certificate is what the Recorder needs to see. Have originals ready, not just photocopies.

After the ceremony, your officiant signs the license and files it with the Lake of the Woods County Recorder within five days. Two witnesses must be present and sign as well. Both witnesses need to be at least 16 years old. These rules come from Minn. Stat. 517.08 and apply to all Minnesota counties the same way.

The best starting point for an online search is the Minnesota Official Marriage System (MOMS). It covers Lake of the Woods County and lets you look up records by name. The system shows you basic details like the names of the parties and the date of the marriage. It does not give you the actual document.

For a certified copy, you need to contact the Recorder directly. You can go in person to the Baudette office, send a written request by mail, or call to ask about their preferred process. The fee is $9.00 per certified copy. Bring or include a description of the record you need, full names of both parties, and the approximate year of the marriage.

For older records from before MOMS coverage, the Minnesota Historical Society at libguides.mnhs.org/vital/marriage has genealogical indexes and some original records. Because Lake of the Woods County is relatively new (1922), records before that year may be in Beltrami County files.

Minnesota Marriage Law Overview

All Minnesota counties follow the same base marriage laws under Chapter 517 of Minnesota Statutes. Both parties must be at least 18. There is no state residency requirement, meaning out-of-state residents can marry in Minnesota without issue. The ceremony must take place in Minnesota for the license to apply.

Under Minn. Stat. 517.01, only certain people can legally perform a marriage. Judges, court administrators, and ordained or licensed clergy are the most common. The officiant must return the signed license to the county within five days per Minn. Stat. 517.10. Failure to file does not invalidate the marriage, but it creates problems for the official record.

Lake of the Woods County keeps all marriage records permanently. Certified copies can be used in court, for name changes, for Social Security applications, and for many other legal purposes. The Recorder can certify copies that carry the same legal weight as the original.
